<p>Creature Academy has disappeared from the App Store and Google Play two days after an artist claimed the developer unofficially used his IP.</p><p>The artist is Kevin Konrad Hanna and it's his web comic "Creature Academy: The Legacy" that he claims Kabam has used without officially licensing it.</p><p>His comic was started back in 2011 while Kabam didn't launch its monster-catching RPG Creature Academy on iOS and Android until November 20th 2014.</p><p>Hanna compares his web comic to Kabam's game in a comic strip, which reads:</p><p>"Released a couple of years ago, Creature Academy is about a group of kids who attend a magic school, tasked with collecting magic creatures... (griffons, basilisk, leviathan...) after an epic magic event."</p><p>"Released a few months ago, Kabam's Creature Academy is about a group of kids who attend a magic school, tasked with collecting magic creatures... (griffons, basilisk, leviathan...) after an epic magic event."</p><p>Hanna says that he asked Kabam to change the name of its game after it created brand confusion when he spoke to companies about making a movie and game based on his comic.</p><p>Kabam apparently refused to do so, saying that a graphic novel doesn't give him ownership of a name or story.</p><p>When GamePolitics contacted Kabam about the matter, a representative said the following:</p><p>"The author is wrong on the law and the facts. A single work of authorship, which — even if published prior to Kabam’s game — does not provide trademark protection."</p><p>Hanna read this and found it "maddening." He then talked to his lawyer to check this claim out from Kabam. The response was then quoted in an update to Hanna's Tumblr post:</p><p>"Mr. Hanna has extensive use of the CREATURE ACADEMY trademark in areas outside a single comic book," shutting down Kabam's response immediately.</p><p>But then the lawyer quotes a previous court ruling that states "even a single use in trade may sustain trademark rights if followed by continuous commercial utilization."</p><p>So it seems that what Kabam claims is false.</p><p>The lawyer also added that "Mr. Hanna has been consistently using the CREATURE ACADEMY name for over five years. Mr. Hanna is the rightful owner of the CREATURE ACADEMY trademark."</p><p>Hanna's last public statement on his Tumblr was that he wasn't pursuing a legal battle over this. But noted that he reserves the right to change his mind on that matter.</p><p>Since then, as said, Creature Academy has disappeared from the App Store and Google Play. The Two Bags<p>Path to Mnemosyne is one of the more thought-provoking indie games out there, and it's coming to your mobile device soon, as we originally reported on earlier this month. The game is essentially about a little girl solving puzzles to recover lost memories. </p><p>It features a unique black & white visual presentation that really stands out. It looks sort of like a mix of an old-fashioned TV show and a drawing in motion.</p><p>Easily the most interesting concept is the type of sub-genre it is (aside from being a puzzle game). The game is not violent, nor is it intended to be terrifying in any way, but it's supposed to make you feel totally uncomfortable with its hypnotic presentation.</p>
<p>The rather brilliantly named Willy Jetman: Astromonkey's Revenge is indeed a real game, and it's flying its way towards an iOS and Android launch on July 9th.</p><p>This one's an arcade shooter that first made the rounds on consoles and PC earlier this year. <p>Spending months or even years working on an app release can be an arduous business, and the fruits of your labour are something that needs shouting about from every virtual rooftop.</p><p>As it stands, most apps are released solely through the App Store or Google Play, which do indeed reach a wide audience, but don’t tackle countries such as China with their releases.</p><p>In a recent report China, called Mobile Advertising & User Acquisition, it was found that China is on track to top $10 billion in 2016 with its mobile game industry, with a height of $13.9 billion by the year 2019.</p><p>China’s new answer to this otherwise difficult-to-penetrate country comes in the guise of new online portal, APPTUTTi. This service allows developers to get their apps noticed in the Chinese market, with a simple sign-up process and the knowledge on how to ensure the creation is in keeping with Chinese standards.</p><p>Currently available to try for free, there’s absolutely no reason as to why budding publishers and developers shouldn’t strive to break onto China’s mobile gaming scene – especially not when China is currently largest Android market since 2015.</p>

Sink all of the balls, but mind where you're potting them. Choose your teams, rank them up, playing in season and leagues, upgrade your players, and lead your crew to sweet, sweet victory.</p><p>Nintendo revealed its big plans for the Switch’s premium online service which will bring Cloud saves and other helpful tools the Switch has been sorely missing. However, Virtual Console is not part of the package, nor will it ever be, according to Nintendo.</p><p>Kotaku confirmed with Nintendo that the Virtual Console will not be bringing retro games to Switch as it has done in the past with the 3DS, Wii and Wii U. The Switch will not have a dedicated section just for classic games.</p><p>That doesn’t necessarily mean that Nintendo is dropping its retro favorites entirely, however. Classic games just won’t all be tied together under the united Virtual Console banner. They’ll instead be available for you to pick and choose as part of the new Switch Online service, or in their own independent collections.</p><p>“There are a variety of ways in which classic games from Nintendo and other publishers are made available on Nintendo Switch, such as through Nintendo Entertainment System – Nintendo Switch Online, Nintendo eShop or as packaged collections,” a Nintendo representative told Kotaku. “Nintendo Entertainment System – Nintendo Switch Online will provide a fun new way to experience classic NES games that will be different from the Virtual Console service, thanks to enhancements such as added online play, voice chat via the Nintendo Switch Online app and the various play modes of Nintendo Switch.”</p><p>Indeed, the company did announce that 20 NES games will be available at the start of the online service, including fan favorites like Super Mario Bros. and the Legend of Zelda.</p><p>Will you be missing the Virtual Console, or are you excited to see what Nintendo has in store for its classic games library? </p>
